Terms & Conditions

Important: HaulyX is a technology platform only. We are not an employer, recruitment agency, labour-hire provider, transport operator, freight broker or workforce supplier. We do not employ, engage, supervise, dispatch, insure or pay drivers, and we are not a party to any agreement, job, load or transaction arranged between users of the platform.

1.About HaulyX

HaulyX (operated by HaulyX Pty Ltd, ABN to be confirmed, “HaulyX”, “we”, “us”) provides an online marketplace that allows Australian businesses (“Businesses”) and independent truck drivers and owner-operators (“Drivers”, together with Businesses, “Users”) to find each other and arrange transport work.

By accessing, signing up to, or using the HaulyX website, waitlist, app or any related service (the “Platform”), you agree to these Terms & Conditions. If you do not agree, do not use the Platform.

2.Our role — platform only

HaulyX is solely a venue and technology service. All work, jobs, loads, rates, contracts and payments listed, requested, offered, negotiated or accepted on the Platform are between the Driver and the Business directly.

We expressly do not, and do not purport to:

  • employ, engage or contract any Driver;
  • act as an agency, labour-hire provider, employer of record or recruiter;
  • operate trucks, hold transport authorities, or perform freight services;
  • set, guarantee, collect or pay rates or wages;
  • supervise, direct, train, roster or dispatch Drivers;
  • verify the accuracy of any listing, profile, licence, qualification, insurance, ABN, vehicle, review or message;
  • guarantee the conduct, performance, safety, identity, solvency or legality of any User.

All Drivers using the Platform do so as independent contractors operating their own ABN and their own business.

3.No responsibility for jobs, conduct or outcomes

To the maximum extent permitted by law, HaulyX takes no responsibility for:

  • any job, load, route, contract, offer or transaction arranged via the Platform;
  • non-payment, late payment, underpayment or disputes over rates;
  • damage to freight, vehicles, equipment or property;
  • injury, illness, death, accident or incident occurring before, during or after any work;
  • breaches of road, transport, work health & safety, chain-of-responsibility, fatigue, tax, immigration or any other law;
  • misrepresentation, fraud, defamation or harassment by any User;
  • the accuracy, legality, quality or safety of any User, vehicle, listing, message, review or content.

Users deal with each other entirely at their own risk and are solely responsible for satisfying themselves about the other party before agreeing to any work.

4.Driver and Business obligations

You must, at all times:

  • hold and maintain all licences, accreditations, insurances, registrations and an active ABN required to perform or arrange the relevant work;
  • comply with all applicable Australian laws, including road transport, heavy vehicle, fatigue, WHS, tax (including GST and PAYG), superannuation and contractor laws;
  • provide true, accurate and current information in your profile, listings and messages;
  • handle your own invoicing, tax and superannuation arrangements as an independent business;
  • not use the Platform for unlawful, misleading, abusive or harmful purposes.

5.Independent contractor status

Nothing on the Platform creates an employment, partnership, joint venture, agency or labour-hire relationship between HaulyX and any User, or between Users themselves except as expressly agreed between them. Drivers are not entitled to wages, leave, superannuation, workers compensation or any other entitlement from HaulyX.

6.Waitlist and early access

Submitting your email or expression of interest places you on a waitlist only. It does not create any contract, guarantee of access, work, customers, pricing or service from HaulyX. Features, launch timing and availability may change at any time.

7.Content and messaging

You are solely responsible for the content you submit, including messages, offers, profile information and reviews. You must not post anything that is unlawful, defamatory, misleading, discriminatory, harassing, infringing or unsafe. We may remove content and suspend or terminate accounts at our discretion, without notice and without liability.

8.Disclaimers

The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, HaulyX excludes all warranties, representations and guarantees (express or implied) regarding the Platform, its availability, accuracy, suitability, security, or any User or content on it.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

9.Limitation of liability

To the maximum extent permitted by law, HaulyX, its directors, employees and contractors will not be liable for any loss, damage, cost, claim or expense (including loss of profit, revenue, freight, data, goodwill, opportunity or any indirect or consequential loss) arising out of or in connection with your use of the Platform, any job or transaction between Users, or any conduct of any User.

Where liability cannot lawfully be excluded, our total aggregate liability to you is limited, at our option, to resupply of the Platform service or AUD $100, whichever is lower.

10.Indemnity

You indemnify HaulyX against all claims, losses, damages, liabilities, costs and expenses (including legal costs on a full-indemnity basis) arising from or in connection with your use of the Platform, your content, any job or transaction you enter into via the Platform, and any breach by you of these Terms or any law.

11.Suspension and termination

We may modify, suspend, restrict or terminate your access to the Platform at any time, for any reason, without notice and without liability to you.

12.Privacy

We collect and handle personal information in accordance with the Australian Privacy Principles. By using the Platform you consent to us collecting and using your information to operate, improve and communicate about the Platform, including sending transactional and service emails.

13.Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

14.Governing law

These Terms are governed by the laws of Western Australia, Australia. You submit to the exclusive jurisdiction of the courts of Western Australia and the courts competent to hear appeals from them.
